Injury - Auto Collision Claims
The most common and serious mistake made by injured parties in an
automobile collision is their failure to seek medical advise at
once. Furthermore, it is necessary to have a follow up physical
or mental examination at least within a few days to a week after
the collision because many injuries do not surface until some days
have past. What does not show up in an initial emergency room visit
may well show up in a comprehensive exam by your private physician
or on a return trip the emergency room. Names of eyewitnesses and
photos of the scene can be crucial to secure truth and victory at
a later time.
At the scene
of the collision, do not tell the investigating officer or the
adverse driver that you are not hurt unless the collision is very
minor and you are 100% positive you are not hurt. You never get
rewarded by being a hero and saying, "Oh, I'm not really
hurt." If you are numb or start to ache, be sensible and
protect your own interests and those of your family by stating
that you are going to the emergency room to be examined. If you
or your passengers are hurting at the scene, request that EMS
be called for an on the scene examination of any potentially injured
parties.
A driver's
liability for an automobile collision is generally regulated by
State Statutes and by Common Law. Any injuries resulting from
an automobile collision must be related directly or proximately
to the event that occurred, i.e., that automobile collision. This "relation to" has to be done with professional testimony,
such as that of a physician, unless you receive broken bones or
severe lacerations and bruises which are obvious at the scene
of the collision.
When we accept

fees out of the adverse insurance funds collected for you. Additionally,
suit expenses may be advanced by the client or our firm, but we
always attempt to collect suit expenses from the adverse insurance
funds. These matters will be discussed and agreed to when you
contract with our firm to handle your case.
